This policy explains how MGE DIGITAL CANADA INC. (Ontario Corporation Number 2864039, registered at 22 Adelaide Street West, Suite 3400, Toronto, Ontario, M5H 4E3, Canada) uses cookies and similar technologies on this website, what each category does, the legal basis for using it, and how you can control or withdraw your consent.

1. What cookies and similar technologies are

A cookie is a small text file that a website asks your browser to store and send back on later visits. It lets the site recognise the same browser from one page to the next — which is how you stay signed in instead of logging in again on every click.

Several other technologies do comparable things, and this policy covers all of them:

  • Local storage and session storage. Browser storage that holds small values for a site. We use local storage to remember your answer to the age and location question so you are not asked on every page. That value never leaves your browser.
  • Pixels and web beacons. Tiny embedded images or scripts that report that a page or message was opened. We do not use them on public pages of this site.
  • Device fingerprinting. Deriving a semi-unique identifier from device characteristics such as screen size, fonts and time zone. We use signals of this kind only for security and fraud prevention — detecting an account being accessed from an unusual device — and never to build an advertising profile.
  • Software development kits (SDKs). Third-party components embedded in an app or page that may set their own identifiers.

4. Legal basis — PIPEDA and CASL

Two Canadian laws govern this, and they cover different things.

PIPEDA — the Personal Information Protection and Electronic Documents Act — applies where a cookie involves personal information. It requires that you know what is being collected and why, and that you consent, except where an exception applies. The more sensitive the information, the more explicit that consent has to be.

CASL — Canada’s Anti-Spam Legislation — goes further than its name suggests. Besides commercial electronic messages, it regulates the installation of computer programs on another person’s device, which covers some cookies and scripts. CASL treats consent as implied for cookies a reasonable person would expect from ordinary browsing, and requires express consent for anything beyond that. That distinction is why the analytics category above is off until you agree, while the session cookie is not.

  • Strictly necessary, security and geolocation. Set without a consent prompt. They fall within CASL’s implied consent, or are required of us by law and by the regulator.
  • Functional. Implied consent from your use of the feature — for example, answering the age question stores your answer.
  • Analytics and marketing. Express consent only. We ask, in plain words, and nothing is set until you agree. A pre-ticked box is not consent, and neither is silence.
  • Record. We record what you consented to and when, so the preference is not lost and so we can show it if asked.

6. Managing cookies and withdrawing consent

You can change your mind at any time, and it is not made difficult.

  • In your browser. Every current browser lets you block or delete cookies and clear local storage, per site or entirely. Look under Privacy or Site settings.
  • Withdrawing express consent. Contact our Privacy Officer at privacy@playfallsview.co. We act on the request promptly and confirm it.
  • Marketing opt-out under CASL. Every commercial message includes an unsubscribe mechanism that works for at least 60 days, and we act on it within 10 business days as CASL requires. You can also withdraw consent in your account settings, or by writing to us. It is never a condition of holding an account.

Blocking strictly necessary cookies will stop you signing in or completing registration. Blocking geolocation means game content will not load, because we cannot confirm you are in Ontario. Neither is a penalty — the service genuinely cannot work without them.

7. Third parties and transfers outside Canada

We do not sell information collected through cookies, and we do not allow third parties to place advertising cookies on the public pages of this site.

Some service providers — hosting, security, geolocation verification and, if you consent to it, analytics — process data outside Canada, including in the United States and the European Union. Where that happens the information may be accessible to the courts, law enforcement and national security authorities of that country under its own laws. We remain accountable for it and use contractual and organisational measures intended to give comparable protection.

Where a provider such as an analytics or advertising platform would set its own identifiers, it does so only after your express consent, and its own policy applies in addition to this one. You may ask our Privacy Officer which providers are in use at any given time.

8. Geolocation technologies

When you open game content, your device is asked for its location and the result is checked against the province. This is a regulatory requirement in Ontario, not a commercial choice, and it is not optional if you want to play.

The check returns whether you are inside the province. We keep the result of the check and the technical data needed to evidence it; we do not use it to build a movement history or an advertising profile. A VPN or proxy will normally cause the check to fail — using one to disguise your location breaches our Terms and Conditions.

9. Oversight and complaints

If you are not satisfied with how we have handled cookies or your personal information, contact our Privacy Officer first — the address is in section 11. If our answer does not satisfy you, you may complain to the Office of the Privacy Commissioner of Canada (OPC), which oversees compliance with PIPEDA and, together with the CRTC and the Competition Bureau, enforces CASL.

10. Changes to this policy

We may update this policy to reflect changes in the law, in regulatory requirements or in the technologies we use. The effective date at the top always shows the current version.

Where a change materially affects how we use cookies — a new category, or a new third party — we will tell you through the site and, where you have an account, by email before the change takes effect. Where the change relies on your consent, we will ask for it rather than assume it. Continuing to use the site after a non-material change means you accept the updated policy.
